Dwelling in Bushfire Area, Foster

Having had my planning permit expire for a new architect designed house on 10 acres of bushland in the Shire of South Gippsland, and then being caught up in the new regulations resulting from the Victorian bushfires, I was overwhelmed at the complexity of the matters I needed to deal with to regain the permit. Living interstate I needed local knowledge and I engaged Glenn Kell to assist me. Though a long and tortuous process, Glenn guided me with a sure and steady hand. His professional approach, deep knowledge of the planning system and ability to negotiate with the various parties , including Council and the CFA, ensured that the permit was regained. Glenn was a pleasure to deal with through what became a complex and difficult journey.”

I am so grateful to Glenn for saving my building project.  After having problems with my builder, I went to Council for an extension of time on the Planning Permit.  I was told that I had to resubmit a Permit application under the new BMO and discovered that this would be difficult if not impossible.  My dream block was suddenly worthless.

Glenn went through all of my documentation and identified the vegetation clearing that I had done under the Permit as being commencement of work.  Council rejected this so Glenn took my case to VCAT where we won and my project is now back on track.  Without Glenn’s initial investigation, preparation for the VCAT hearing and selection and briefing of the lawyer, I don’t believe it would have been possible for me to sell the block, let alone build on it.”

Mirboo North Sand Quarry

“Glenn Kell was recommended to assist us for our quarry application in Mirboo North. The planning application attracted approximately 40 objections, a petition with 150 signatures and Council decided to refuse that application.  Upon Glenn’s advice we appealed this decision to VCAT and won.  From first being engaged, to the VCAT representation and then complying with permit conditions – Glenn took full control our planning application whilst keeping us informed and involved in key decisions.  We now have a valuable quarry that not only complements our farming operation but provides an opportunity to provide local & regional projects with this material”.
